Speed Spell Terms of Use and EULA

These Terms of Use and End User License Agreement ("Terms") govern your access to and use of the Speed Spell mobile app, related features, content, subscriptions, leaderboards, and support services provided by Shiver Software ("Shiver Software," "we," "us," or "our").
By downloading, installing, accessing, or using Speed Spell, you agree to these Terms. If you do not agree, do not use the app.
Eligibility
You must be at least 13 years old to use Speed Spell. If you are under the age of majority where you live, you may use the app only with permission from a parent or legal guardian.
License
Subject to these Terms, Shiver Software grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use Speed Spell for personal, non-commercial entertainment purposes on devices you own or control and as permitted by the app store terms that apply to your download.
You may not copy, modify, reverse engineer, decompile, disassemble, distribute, sell, rent, lease, sublicense, or create derivative works from Speed Spell except where applicable law allows such activity despite this restriction.
Accounts, Scores, and Leaderboards
Some features may require an account, display name, or other player profile information. You are responsible for the accuracy of information you provide and for activity associated with your account. We may remove, adjust, or refuse scores, leaderboard entries, display names, or other content that appears fraudulent, abusive, unlawful, infringing, or inconsistent with these Terms.
Subscriptions and Purchases
Speed Spell may offer subscriptions, in-app purchases, or paid features. Purchases are processed by the app store or payment provider you use and are subject to that provider's payment, renewal, cancellation, and refund terms. You can manage or cancel subscriptions through the account settings provided by the app store.
Acceptable Use
You agree not to:
- use Speed Spell for unlawful, harmful, or abusive activity
- harass, threaten, impersonate, or mislead other users
- cheat, automate gameplay, exploit bugs, or manipulate scores
- interfere with app security, availability, or infrastructure
- upload or transmit malware, spam, or unauthorized advertising
- violate third-party rights or applicable third-party terms
Ownership
Speed Spell, including its software, gameplay design, artwork, text, audio, trademarks, and other content, is owned by Shiver Software or its licensors and is protected by intellectual property laws. Except for the limited license above, no rights are granted to you.
User Content and Feedback
If you submit support messages, feedback, suggestions, names, leaderboard entries, or other content, you grant Shiver Software a worldwide, royalty-free license to host, use, reproduce, modify, display, and process that content as needed to operate, support, and improve Speed Spell. You represent that you have the rights needed to provide any content you submit.
Privacy
Our Speed Spell Privacy Policy explains how we collect, use, and share information in connection with the app.
Updates and Availability
We may update, modify, suspend, or discontinue Speed Spell or any feature at any time. We are not responsible for outages, data loss, device compatibility changes, app store availability, or third-party service interruptions.
Termination
We may suspend or terminate your access to Speed Spell if you violate these Terms, create risk or legal exposure, or misuse the app. You may stop using the app at any time by deleting it from your device. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and dispute provisions.
Disclaimers
Speed Spell is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the app will be uninterrupted, secure, error-free, or that scores or gameplay data will always be preserved.
Limitation of Liability
To the maximum extent permitted by law, Shiver Software will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or service interruption arising from or related to Speed Spell or these Terms. To the maximum extent permitted by law, our total liability for any claim will not exceed the amount you paid to use Speed Spell during the 12 months before the claim arose or $100, whichever is greater.
Indemnity
You agree to defend, indemnify, and hold harmless Shiver Software from claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising from your use of Speed Spell, your content, or your violation of these Terms.
Apple App Store Terms
If you downloaded Speed Spell through the Apple App Store, you and Shiver Software acknowledge that these Terms are between you and Shiver Software only, not Apple. Shiver Software, not Apple, is solely responsible for Speed Spell and its content.
Your license to use Speed Spell on Apple-branded products is limited to a non-transferable license to use the app on any Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Speed Spell may be accessed and used by other accounts associated with you through Family Sharing, volume purchasing, or similar Apple features where permitted.
Apple has no obligation to provide maintenance or support services for Speed Spell. To the extent any warranty applies and is not effectively disclaimed, you may notify Apple, and Apple may refund the purchase price, if any, for Speed Spell. To the maximum extent permitted by law, Apple will have no other warranty obligation for Speed Spell.
Shiver Software, not Apple, is responsible for addressing claims relating to Speed Spell or your use of it, including product liability claims, legal or regulatory claims, consumer protection claims, and intellectual property infringement claims.
You represent and warrant that you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms when using Speed Spell, including your wireless data service agreement. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, except where local law requires otherwise.
Changes to These Terms
We may update these Terms from time to time. When we do, we will update the date above and post the revised Terms at this page. Your continued use of Speed Spell after changes become effective means you accept the updated Terms.
